India's citizenship rules for PoK residents: three scenarios explained

India legally considers residents of Pakistan-occupied Kashmir (PoK) Indian nationals, but their rights hinge on where they live and legal status. A J&K court has ruled PoK-origin individuals cannot be treated as foreigners. Those currently in PoK can't access Indian citizenship rights without entering India, while families displaced in 1947 and later conflicts enjoy full J&K domicile rights. The Citizenship (Amendment) Act does not apply to PoK residents, as they are already citizens.
